No warranty and no liability: $HUT is provided on an “as is” basis and without any warranties of any kind, either expressed or implied. You assume all responsibility and risk with respect to acquiring any amount of $HUT, and using them. The Company, the Distributor, and the Hibiki Run Project Contributors disclaim all warranties, representations and conditions of any kind, whether express or implied, including, without limitation, any warranties or conditions of merchantability, fitness for a particular purpose, title or non-infringement.

In no event shall the Company, the Distributor, their respective affiliates or the Hibiki Run Project Contributors be liable for any direct, indirect, incidental, special, exemplary, punitive, consequential or other damages whatsoever (including but not limited to, liability for loss of use, data or profits), without regard to the form of any action, including but not limited to, contract, negligence or other tortious actions, arising out of or in connection with the Token Documentation, the Website or any other materials published by the Company or the Distributor, or any copy or use thereof, even if the Company or the Distributor have been advised of the possibility of such damages. In addition, the Company, the Distributor, their respective affiliates and the Hibiki Run Project Contributors do not accept and hereby disclaim all responsibility and liability in relation to the availability, operability, and performance of the Hibiki Run platform or $HUT.

Arbitration: Any dispute arising out of or in connection with the Token Documentation, the Website, the distribution and/or use of $HUT, or any related services provided by the Company, the Distributor, or the Hibiki Run Project Contributors shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce (ICC) by one or more arbitrators appointed in accordance with the said Rules.

Governing law: The Token Documentation, the Website, the distribution and/or use of $HUT, and any related services provided by the Company, the Distributor, or the Hibiki Run Project Contributors shall be governed by, and construed in accordance with the laws of Seychelles.

Miscellaneous: The Company and the Distributor have the right to change, modify, add, or remove portions of the Token Documentation and the Website for any reason at any time before, during and after the sale of $HUT by posting the amended Token Documentation or Website on the Website. Such changes will be effective immediately upon posting. By purchasing $HUT, you acknowledge that you have read, understand, and have no objections to these terms.
